1. Introduction

This Privacy Policy explains when we collect information about you, including Personal Information (“PI”), what we collect, why we collect it, how we use it, who we share it with, where it is processed, how we handle it and your choices and legal rights associated with this information. If you are at all concerned about the way that your personal data is used as described in this Privacy Policy, please refrain from using our Services.

From time to time, we may ask you to confirm your acceptance of this Policy when we offer our Game and Services.

2. Scope of This Policy

Fntastic Pte. Ltd., a company incorporated in Singapore ("Company", “we,” “our,” and “us”) collects data from you, through our interactions with you and through our game X HERO TD (the “Game”), websites, and related Services. You provide some of this data directly, and we get some of it by collecting data about your interactions, use, and experiences with our products. The data we collect depends on the context of your interactions with us and the choices you make, including your privacy settings and the products and features you use. We also obtain data about you from third parties.

3. Data We Collect

• Basic Identifiers and Contact Information: We collect some information from you when you provide it to us directly, such as via an email or online form, through the support feature embedded in our Services, or through another form of inquiry. This information may include your name, email, and phone number.
• Age: We may ask your age in order to further manage the advertising and individual Game functions depending on it at the first Game launch.
• Game usage data: We collect anonymous data about Game launches, the frequency and duration of the sessions, the progression process, making purchases, failures, and other events while using the Game. Such statistics contribute to the Games improvement, hereby making it more interesting and fun. For example your game progress which may be stored with your Apple ID on iCloud for iOS Devices, with your Google Play Games profile for Android Devices and with Google Analytics.
• Unique advertising device identifiers: We may use unique Google Advertising ID or Apple ID for Advertisers device identifiers to work with ad networks, personalizing the displayed ads. You may disable ads in the Game by purchasing the “ads disabling” in the store (if the Game supports ads disabling).
• Country and approximate location: We may get the country’s name and approximate location, which doesn’t allow us to determine your exact location, to personalize advertising and analytics.
• Device data: Your device (manufacturer, model) and operating system (version) data are may obtained and used for analytics and technical support of users. They help us to identify crashes and errors on various devices and fix them.

A User may provide the data independently, or the data collection can be automatically carried out by the Game when it is used.

All Data requested by the Game is mandatory unless otherwise specified. The Game may be unable to provide its services in the event of failure to provide the specified Data. The Users are entitled to refuse from the relevant Data report without any consequences in terms of the Service availability or operation if the Game directly indicates the optional presentation of certain Data.

4. Data Controller

In the context of this Privacy Policy, Fntastic Pte. Ltd. acts as a data controller for the data we process.

5. Legal Basis for Processing

We will only use your information for certain specified reasons and only where we have a lawful basis to do so. The lawful bases we rely on depend on the type of relationship we have with you and how we interact with you. They include the following:

Contract – to provide our products and services to you and fulfill our contractual relationship with you.

Legitimate Interests – to fulfill our legitimate interests, or those of a third party, in conducting and managing our business and our relationship with you as described in this Privacy Policy.

Legal obligation – to meet our legal obligations under applicable law (e.g. financial reporting).

Consent – where you have provided us consent to process your PI for a specific purpose.

6. Use of Personal Data

• We use the collected information for various purposes, primarily focused on providing Games and Services to players like you and improving the quality of our Games and Services. These purposes include:
• Managing Games and Services and delivering them to you.
• Developing new games, enhancing the quality of our Games and Services, and addressing issues.
• Identifying illegal or unauthorized use of our Games and Services and responding to such cases.
• Communicating with you about any contact forms, helpdesk support and to understand how you use our Games and Services so that we can continuously improve our offerings. 
• Providing promotional information and other details about marketing and advertising events and surveys.
• Monitoring usage patterns, analyzing user behavior trends, and calculating statistical data on the use of Games and Services.
• Compiling user statistics and providing in-game metrics (if the Game supports it).

7. Account Deletion

Should you wish to delete your Account completely, please go to Settings > Delete Account, and follow the instructions shown. Please note that if you delete your Account, all your progress in our games and any unspent virtual items will be lost, and we will not be able to restore them in the future. Once you delete your Account, we de-identify the data associated with your Account and only retain de-identified Analytics Data (as defined above) for analytics purposes. We cannot identify persons with this information because it does not contain names, email addresses, or other identifiers. However, if we need to retain data in your Account to comply with applicable laws (such as requirements to retain records of data subject requests and how we responded to them under applicable privacy laws), or to establish, exercise or defend our legal rights (such as to continue to enforce our Terms of Service), we will retain the data in your Account that is necessary to fulfil such purposes, for as long as is necessary to fulfil such purposes, and use it only to fulfil such purposes, even if you ask us to delete your Account.

8. Information Sharing and Transfers

This section explains how we may share the information we collect with third parties that provide services that you use. We do not and will not accept money in exchange for sharing PI. We may share your information with the following recipients and for the following purposes.

• Service Providers

We share information with service providers to Company, who are persons or companies that provide services which may include handling PI for any of the purposes described in this Privacy Policy. Service providers are required to adhere to confidentiality and security requirements.

• Partners

We may share information with the following partners:

Security and fraud partners as appropriate to support the security of our products, fraud prevention, or protect PI.

Partner cloud computing service providers to provide cloud storage services.

Marketing platforms and providers of analytical services relating to player behavior in order to adapt the Service and carry out marketing activities;

Providers of online polling services to improve the game service.

Business transfer partners, in connection with the negotiation and sale of the applicable business, a portion of the business, or certain stock and/or assets, or a corporate merger, consolidation, restructuring, or other corporate change including, without limitation, during the course of any due diligence process.

• Other Users

Content you have shared.

You are responsible for any content you share using blogs, chat, and messaging features. This content will be accessible to other users, who can then share that information further. We recommend you consider carefully what you share and with whom you share your information.

• Government & Authorities

We may share your information with police, government, and other authorities if we believe that it is reasonably necessary to comply with a law, regulation, or legal process, to detect, protect, and enforce the safety of any person, their property, or their rights, to address fraud and security and report criminal activity.

9. International Data Transfers

As we operate worldwide to provide our Games and Services all PI may be stored anywhere in the world, including, but not limited to, in the cloud, on our servers and on the servers of our affiliates or the servers of our Service Providers. When we transfer, store, or process your personal information, we take reasonable measures to protect its confidentiality, including entering into confidentiality agreements and standard contractual clauses with our vendors where applicable. Please note that laws vary from jurisdiction to jurisdiction, so the privacy laws applicable to the places where your information is transferred to or stored, used or processed in may be different from the privacy laws applicable to the place where you are resident. Your information may be transferred to, and maintained on, computers located outside of your state, province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction.

By providing information to us, you consent to the storage of your Personal Information in these locations.

10. Children’s Privacy

We do not knowingly collect, use, or intentionally disclose any information about children under the age of 13 (or under 16 in certain jurisdictions in the European Union) without proper parental consent or as required by law. If you are a parent or guardian and believe that your child has provided us with information, you may contact us to request the removal of your child's information from our system.

If we discover that we have collected personal data about a child under the legal minimum age requirement, we will delete that data as quickly as possible.

We take reasonable measures to protect the information that we collect from or about you (including your information) from unauthorized access, use or disclosure. Please be aware, however, that no method of transmitting information over the Internet or storing information is completely secure. Accordingly, we cannot guarantee the absolute security of any information.

Your data is stored no more than is required to ensure the Game operation and the services it uses.

Our Services may contain links to other websites and services. Any information that you provide on or to a third-party website or service is provided directly to the owner of the website or service and is subject to that party’s privacy policy. Our Privacy Policy does not apply to such websites or services and we’re not responsible for the content, privacy or security practices and policies of those websites or services. To protect your information we recommend that you carefully review the privacy policies of other websites and services that you access.

14. Analytics and Data Partners

Google Analytics is the analytical service provided by Google LLC.
